Smooth Summer Sweepstakes Rules
SWEEPSTAKES PERIOD: The European Wax Center Smooth Summer Sweepstakes (“Sweepstakes”) is being offered at participating European Wax Center locations throughout the United States. The Sweepstakes starts on May 15, 2023 (at the opening of each participating location’s regular business hours) and concludes on September 30, 2023 (at the close of each participating location’s published business hours) (the “Sweepstakes Period”).
ELIGIBILITY: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are at least 18 years of age. Employees, officers, directors, members, agents, and representatives of EWC Ventures, LLC d/b/a European Wax Center (“Sponsor”), its franchisees and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, officers, directors, members, agents, and representatives are not eligible to enter or win. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.
HOW TO ENTER: You may enter the Sweepstakes in either of the following ways: During the Sweepstakes Period, visit this site: HERE and register for the promotion by following the instructions provided. Once registered, visit a participating European Wax Center location for your waxing reservation under the same information you registered with. Each completed waxing reservation during the Sweepstakes Period will count as a separate entry in the Sweepstakes. To enter the Sweepstakes without purchase, please legibly handprint in blue or black ink on a 3" x 5" postcard your full name, complete home address and zip code, date of birth, e-mail address, mobile phone number and the Sweepstakes you are entering. Mail this completed postcard in a first-class stamped envelope to European Wax Center Smooth Summer Sweepstakes, Attn: CRM Marketing Department, 5830 Granite Parkway, Suite 300, Plano, TX 75024. No metered mail will be accepted. All mail-in entries must be postmarked by September 30, 2023 and received by October 2, 2023. No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail. Limit one (1) entry per outer mailing envelope. All entries become the sole property of the Sponsor and will not be returned. Entries generated by mechanical means and entries made by any means which subvert the entry process will be void.
PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS OF WINNING: The Prize in the Sweepstakes is as follows:
Grand Prize: One (1) $5,000 gift card for a shopping spree (Approximate Retail Value, “ARV” $5,000).
Total number of Grand Prizes available to win: 1.
Total ARV for the Sweepstakes: $5,000. Approximate odds of winning cannot be determined as odds are based on the number of valid Sweepstakes entries received.
PRIZE REDEMPTION AND NOTIFICATION: Sweepstakes winner(s) will be chosen within ten (10) business days of the close of the Sweepstakes period by random drawing. All eligible entries will be combined into a single drawing. Sponsor will attempt to notify winners by the e-mail address and mobile phone number provided on the applicable entry. If winner does not respond within 5 calendar days after attempted e-mail and mobile phone notification by Sponsor to claim the Prize, the Prize will be forfeited and Sponsor reserves the right to choose an alternate winner from the remaining entries that did not win a prize through another random drawing. All drawings will be conducted by Sponsor. All Prize claims are subject to verification and identification in Sponsor’s sole discretion.
PRIZE CONDITIONS: Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not share, substitute, assign or transfer Prize or redeem any Prize for cash. Sponsor reserves the right, at its sole discretion, to substitute Prizes (or portions thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. In the event the Prize exceeds $600 or more the Sponsor, or a third party acting on behalf of the Sponsor, must report the value of the Prize to the IRS in the year the Prize is received by the Prize Winner and will be reported to the Prize Winners and the IRS in the form of a Form 1099. In the event it is deemed during the verification process that the Prize Winner does not have a unique, personal and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of the Prize, the Prize Winner will be disqualified. Valid social security numbers will be determined by IRS requirements. Grand Prize winners will be required to enter into a publicity and liability release (except in Tennessee and as prohibited by law) prior to being awarded Prize.
GENERAL CONDITIONS/RELEASE: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, its franchisees and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, voice, performance, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Sweepstakes without the prior consent of the Sponsor, which it may withhold in its sole discretion.
MISCELLANEOUS: The date and hours of the Sweepstakes are subject to change. Released Parties are not responsible for lost, late, stolen, damaged, inaccurate, incomplete, illegible, mutilated or counterfeit entries, prize claims or data corruption, theft, destruction, unauthorized access to or alteration of entries, loss or otherwise. Released Parties are not responsible for any other errors, malfunctions or problems of any kind, whether printing, seeding, typographical, technical, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors, malfunctions or problems which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or prize claims or in any Sweepstakes-related materials. Sponsor reserves the right, at its sole discretion, to modify or terminate this Sweepstakes, should any technical failures, unauthorized human intervention or other causes corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any participant from the Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliates if his/her fraud or misconduct affects the integrity of the Sweepstakes or who is otherwise in violation of these Official Rules, as determined by Sponsor in its sole discretion, and void all associated entries. You are not a winner until your eligibility and entry have been verified, and it is determined that you have complied with all terms of these Official Rules. Entries are void if they contain any printing, mechanical, seeding, typographical or other errors, if they have been tampered with or obtained other than through authorized channels or if winner does not respond within 5 calendar days after attempted e-mail and mobile phone notification by Sponsor to claim the Prize. In no event will more prizes be awarded than set forth herein in any Sweepstakes. If computer, printing, mechanical, seeding, typographical or other errors result in more valid prize claims for any prize level than the number stated herein for any Sweepstakes, Sponsor reserves the right, at its sole discretion, to award the stated number of prizes for that level in a random drawing from among all eligible, non-suspect and valid prize claims received for such level. All submitted materials in connection with this Sweepstakes become the property of Sponsor and will not be returned. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with each Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Texas, USA.
PRIVACY: All personal information collected as part of this Sweepstakes will be used as set forth in Sponsor’s privacy policy, a copy of which is available at: https://waxcenter.com/pages/privacy-policy.
REQUEST FOR WINNER’S NAMES: For the names of the grand prize winner of any Sweepstakes (available through November 1, 2023) send a self-addressed, stamped envelope to: European Wax Center Smooth Summer Sweepstakes Winner’s List, Attn: CRM Marketing Department, 5830 Granite Parkway, Suite 300, Plano, TX 75024 for receipt no later than November 1, 2023. Please include a 3 x 5 index card specifying the Sweepstakes.
